Membership Terms and Conditions
In these terms and conditions the following words shall bear the following meaning:
BothyBiz means BothyBiz Network, Little Voice Communications Ltd, 56 Dundee Street, Carnoustie DD7 7PF. Email email@example.com.
Member means any Member of BothyBiz or any person or persons intending to or who have applied for membership of BothyBiz upon the terms and conditions contained herein.
Membership Year the Membership Year will run for 12 months from the date a Member joins BothyBiz.
Website means the BothyBiz website www.bothybiz.com and any subdomains linked to and managed by BothyBiz.
There are 2 levels of membership to the BothyBiz network.
- Listing – a listing member is entitled to a listing in the directory and access to the other ‘members only’ areas of the BothyBiz site.
- Web – a web member is entitled to all of the benefits of the listing membership, together with a fully functioning 4 page website. Web members have the option to include a shop on their site. Any merchandise for sale in their shop will also be available to buy on the main BothyBiz site. Members will pay BothyBiz a commission of 15% on any purchases from either shop together with the standard PayPal transactional fees.
2. Membership Details
All applications for membership of BothyBiz are to be made via the subscribe area on the BothyBiz website. By subscribing, the Member is deemed to have signed the application form.
On acceptance of the membership application by BothyBiz, Members shall be bound during the continuance of membership by these Terms and Conditions including any amendments made in accordance with the procedure set out below.
BothyBiz reserves the right at all times and in its absolute discretion to determine the number of Members in BothyBiz and may accept or reject applications for membership as it feels fit.
The annual membership fees are
- Listing member – £3 per month or £30 per annum*
- Web Member £10 per month or £100 per annum*
All membership monies are payable via PayPal, or by credit card. Membership fees are revised at the discretion of BothyBiz and any changes will be notified to Members in by email.
Members have the option to offset future membership fees by introducing new members to the network. This is calculated on a points basis, and accumulated points are reset after membership is paid each subsequent year. The ‘introduce and save‘ area on the BothyBiz site has more details.
Members can also use their ‘introduce and save’ points against any members special offers. These will be displayed on the site from time to time, and communicated in monthly members newsletters.
Members may be able to purchase optional extras, such as featured listings, top level domain names, or design support. The prices for these extras may vary and will either be displayed clearly on the website, or be subject to negotiation.
3. BothyBiz Network
Members will be provided with a username and password to gain access to the BothyBiz network. For web members, these login details will also give them access to their website dashboard.
Members are responsible for maintaining the confidentiality of their login details and passwords, and for all activities that occur under their membership details and passwords, whether by themselves or anyone else using their login details and passwords. Members must ensure that they have any permissions or consents required to include material or links in the BothyBiz network site, or, in the case of web members, their own site.
Use of data from the BothyBiz network for commercial purposes other than the membership conditions set out in clause 1 of this agreement is not permitted.
Members will be asked to fill in personal details such as name, company, address, telephone number, e-mail address, web address and paypal account details (for shop owners).
BothyBiz reserves the right to refuse access to the secure Members only pages. BothyBiz shall not be liable for any loss or damages whatsoever arising from your inability to access any pages on the site.
Any Member wishing to change, add or delete any information on themselves held on the Members only sections of the Website will be able to do so by logging in and amending the details. If you are unable to login or access this area or you forget your login or password, you can contact the Website administrator by emailing firstname.lastname@example.org.
4. Terminating Membership
Membership is to be renewed annually. BothyBiz will email, or write to each Member once the membership is coming up to renewal. If a Member does not pay the annual membership fee, or commit to paying the monthly fee then the membership is not continued and the Member will not have the benefit of membership.
BothyBiz reserves the right to expel Members or to prevent any Member from renewing membership if the Member puts the organisation into disrepute or if a Member is misusing BothyBiz database.
If, for whatever reason, a Member wishes to terminate their Membership, they must give 28 days notice of this in writing, or via email to BothyBiz. We regret we are unable to offer refunds if membership is cancelled for whatever reason before the renewal date unless we receive notice of cancellation within 14 days of taking out membership.
If a member, who is paying their membership fees monthy defaults on their payment, BothyBiz reserves the right to remove their listings and their website immediately.
Web members who wish to move their website to another host may do so for a one off fee of £200. We will supply all of the WordPress site files, or if we are given the new host details we will export the files to the new site location. Unfortunately none of the plugin files can be transferred.
5. Variation of Terms & Conditions
These terms and conditions may be revised from time to time. If they are revised, we will email the revised version to you. It will be your responsibility to keep up-to date with all such changes and your membership renewal and continued use of the Website shall be deemed acceptance of any changes to these terms and conditions.
6. Data Protection and Intellectual Property
It is your responsibility to keep your password and log-in details confidential and use the security devices offered. Our security measures depend on you complying with this obligation and we are not responsible for any breach of your privacy due to your failure either to keep your password secure or to use the other security devices correctly.
We will use your data to administer your membership. Where you obtain information about other Members you must use this in accordance with the Data Protection Act 1998.
Other Members may also use the personal data you make available in the Members directory. Do not make any information public which you do not want other Members to see.
If you have a concern about how another Member is using your personal data, or if you think it is being used in breach of these terms, please contact us at email@example.com.
You acknowledge that the internet is not a completely secure medium, and we therefore cannot be responsible for breaches of security arising out of intentional and/or unauthorised attempts to access the Site, for example, by computer hackers.
7. Governing Law
These terms and conditions shall be interpreted in accordance with Scots law and all disputes shall be subject to the exclusive jurisdiction of the Scottish Courts.
